Golf cart rental agreement

1. The cart

One EZ-GO electric golf cart for up to 4 people, with its key and steering lock. We tell you which cart is yours at pickup.

2. Rental period

The rental starts at noon on the pickup date and ends at noon on the return date. Returning it early doesn't refund the days left. A late return, damage or missing parts are charged extra.

3. Price and payment

The rate is $55 USD a day paid by card, or $45 USD a day paid in cash. Card bookings are paid in full when you book. Cash bookings are paid in full to our team at pickup, in the amount fixed when you booked, and your card is kept as a guarantee.

4. The $500 hold

The day before pickup we place a hold of $500 USD on your card. It is not a charge. We release it once the cart is back in the same condition, ordinary wear excepted. We may take from it the cost of damage, missing parts, a lost key or lock, or a late return, and charge your card for any amount above it.

5. If you cancel

You can cancel online until noon (Sayulita time) the day before pickup. Card payments are refunded, less the card processing fee. After that, or if you don't collect the cart, the first day is charged.

6. If we cancel

These are our own carts, and sometimes one breaks down or isn't available. We may cancel a cart booking at any time without penalty, before or during your rental. You aren't charged for days you don't use, and card payments for those days are refunded in full, card fee included. We can't arrange a replacement cart, but we're happy to suggest Riviera Golf Carts.

7. Rules for driving the cart

These rules apply the whole time the cart is with you. Breaking them may mean losing some or all of the hold.

• Only drivers 18 or older with a valid, full driver's licence may drive. Moped licences and learner's permits are not accepted.
• You may not pass this agreement to anyone else or rent the cart out.
• Turn the lights on after sunset.
• Drive it properly: no horseplay, no racing, and no pushing or pulling other vehicles.
• Town and resort streets only: not on the highway, in restricted areas, off road or on the beach.
• Up to 4 people, everyone seated while it's moving. Never load it with more than 800 pounds (about 360 kg).
• No open alcohol on the cart. Drinking and driving is against the law. Open alcohol, or driving under the influence, ends the rental straight away with no refund.
• Don't repair the cart yourself or pay anyone else to repair it. Tell us and we'll sort it out.

8. Misuse

If the cart is misused, the rental ends and the cart comes back to us, with no refund. Some or all of the hold may be kept for damage. There are no second chances.

9. Accident, theft or fire

Tell us and the police straight away, and don't leave the cart unattended. You are responsible for damage up to the amount of the hold. If an accident wasn't your fault and the other driver's insurance pays for the damage, we give back what you're owed as soon as we can. If you don't follow this clause, you are fully responsible for all damage and costs.

10. Damage and costs

You pay us, when asked, for the loss of or damage to the cart, or damage to property, while it's rented to you, plus reasonable costs of collecting what's owed, including legal fees.

11. Return

Bring the cart back in the same condition you received it, ordinary wear excepted. A lost key costs $10 USD and an unreturned lock $30 USD.

12. Responsibility

You are responsible for, and agree to protect the Owner and their team from, any claim, loss or liability (including injury and damage to property) arising from the use of the cart by you or anyone you let use it, or from any breach of this agreement. The Owner remains responsible for loss or damage caused only by the Owner's own negligence.

13. General

If any part of this agreement can't be enforced, it's read as closely as the law allows to what we both meant, and the rest still applies. Not insisting on a term once doesn't waive it later. This is the whole agreement about the cart rental and replaces anything said before.

14. Signing

You sign this agreement by typing your full name and ticking the box when you book. That counts as your signature. The agreement applies from pickup until the cart is returned. If the English and Spanish versions differ, the English version applies.

Looking after the cart

A golf cart is a vehicle and can hurt people and damage property. Please:

• Park on level ground when you can, with the parking brake on.
• Only switch between forward and reverse when the cart has fully stopped and your foot is off the accelerator.
• Take the key out and fit the steering lock whenever you leave the cart. At night, park it on private property when you can.
• Go slowly on rough roads, dirt and cobblestones, for everyone's safety.
• Plug it in to charge each night.
